Consent to Personal Data Processing
This is a courtesy translation. The legally binding version is the Russian text; in case of any discrepancy, the Russian version prevails.
This consent text applies when the user ticks the separate checkbox “I consent to the processing of my personal data” in the interface of the website or the Mivio mobile application. Ticking the checkbox constitutes a specific, informed, conscious and unambiguous expression of consent in accordance with Article 9 of Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”.
I, a user of the website and the Mivio mobile application (the “Application”), acting freely, of my own will and in my own interest, give my consent to Prequel-Russia Limited Liability Company (Общество с ограниченной ответственностью «ПРИКВЕЛ-РАША»; INN 7704395492, address: Bldg. 1, 1 2nd Karacharovskaya St., Moscow, 109202, Russia; the “Operator”) to process my personal data on the following terms.
1. Personal data covered
- email address;
- photo and video images of my face that I upload to the Application.
2. Purposes of processing
- providing access to the Application’s functionality, including image generation using artificial intelligence algorithms;
- concluding and performing the user agreement;
- user support, handling enquiries and requests;
- compliance with the legislation of the Russian Federation.
3. Processing operations and methods
3.1. Consent is given to the following operations: collection, recording, systematisation, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (provision, access), blocking, deletion, destruction.
3.2. Processing is carried out by automated means, with the information transmitted over the Internet. Personal data is not disseminated.
3.3. The photos and video images I upload are processed solely for the purpose of generating images at my request and are not used by the Operator to establish my identity.
4. Entrusting processing to third parties
4.1. I agree that the Operator entrusts the processing of my personal data under contracts containing a processing instruction, to the minimum extent necessary for each purpose:
- Selectel (selectel.ru) — provision of data-centre infrastructure in the Russian Federation and data storage;
- Paygine (paygine.ru) — payment acceptance for purchases of in-app credits.
5. Cross-border transfer
5.1. No cross-border transfer of my personal data takes place.
6. Term of consent and withdrawal
6.1. This consent is valid from the moment the checkbox is ticked until the purposes of processing are achieved or until it is withdrawn — whichever occurs first.
6.2. I may withdraw my consent at any time:
- by sending a request to info@prequel.team; or
- by deleting my account from the Application interface.
6.3. If consent is withdrawn, the Operator stops processing the personal data and destroys it within no more than 30 days of receiving the withdrawal, except where continued processing is required by the legislation of the Russian Federation. Withdrawal of consent makes it impossible to continue using the Application features that require personal data processing.
